My Principal still does not grant CCL. Where can I appeal?
Madam Ratna, if ur principal does not grant CCL ask him to write the same on your CCL leave application. Of course if u can do it. I am sure he or she will not write it. Try it.
In the referred circular, at point no. iii, it is said that CCL will be granted provided TA/DA is NOT paid. Is it really justified?
I would like to make my query clear with the following example:
1. If employee A of KV Bhopal is deputed for some training in KV Delhi for 10 days during Summer Vacation. He is paid TA/DA. HE WILL GET CREDITED 6 DAYS EARNED LEAVE (E.L.) TOO.
2. If an employee B of another KV Amritsar attends a training at KV Mumbai for 7 days during Summer Vacation. He is paid TA/DA. HE WILL NOT GET CREDITED THE E.L. BECAUSE THE PERIOD IS LESS THAN 10 DAYS, Also as per referred circular he will NOT get CCL too as he is already paid TA/DA.
It means that only due to 3 days (or even A day) less duty, the employee who has been paid TA/DA will neither get CCL nor E.L.
What type of justification is this?
I think that the given rule would be applicable for LOCAL duty only where the CCL should be granted provided TA/DA is NOT paid.
Learned AIKVTA members and KVians may please throw light on my query.

Dear Vipin, I fully agree with you. It always occurs in my mind that if an employee is out of station on duty on Sunday or other holidays,why he or she is left with only one choice between D A or Compensatory Leave. It is not digested easily. He is definitely entitled to DA and he/she must be given CCL also as he/she is working on holiday and that he is on duty for 24 hours…….
Can a PGT also avail compensatory leave?
Rrstoring the permissibility of compensatory leave in lieu of DA in case the teacher is on official duty on second saturdays,sundays,holidays to be put as a demand in our agenda.

sir a person transferred to priority by priority area without completion of tenure. he/ she is eligible for transfer TA ACCORDING TO last transfer guide line. sir please reply soon
if an empmloyee takes transfer at own request from non-priooerity to priority he is eligible for Transfer befnefit in terms of para 8 of new policy.
If he subsequently take tranfer to any other station without completing his tenure he is not eligible for any tranfer benefit.

you are absolutely right, you will get the salary of vacations only if you have completed six months of service in KVS before the commencement of the vacation.

sir my questions regarding vacation salary are:
1 who decide the date of joining for a new recruitee kvs or employee itself?
2. Can an employee refuse to take vacation i.e. summer vacation and can do duties during summer vacation or he is forced to remain on leave during vacation?
3. both joining and vacation are dedided by kvs. what is the fault of the employee?
4. navodaya is holding the vacation pay and releasing the same after the employee completes 6 months of service.
5. in my view the main aim bahind this rule is to ensure that an employee is joining duties after vacation and continuing service so the salary must be withled and be released in future, and not to block the pay.
Our principal is not giving CCL. Please forward CCL letter to all the schools.

sir , I am going as an escort in national sports from 15/10 to 22/10/2012, whereas autmn break starts from 19th. I want to know whether I will get CCL for the dates which came under autmn break i.e. 19, 20, & 21st. DA has not to be paid by myself as it is free whereas I will go along with children so need not to claim TA; how can I show that DA is not being claimed by myself.
If yes,How can I claim for CCL.

Thanks for prompt reply. But, I read in one circular (about 2 or 3 years back) that Class-B officers are not entitled to avail Compensatory Casual Leave. I forgot the exact date and number of the circular. But surely it is issued after the implementation of VI pay commission. I would like to get the copy of it. The matter was also discussed in JCM and in meetings with Commissioner KVS. Though VI th pay Commission recommended certain changes,it has not been adopted by KVS and the earlier provision of compensatory leave has not been superseded by any other circular till date. Even the RTI reply from KVS that I have posted clarifies the issue to a great extent.
Kindly provide information about CCL.Can a PGT avail CCL ?

5. Drawal of pay in the revised pay structure- (on page no 33)
Save as otherwise provided in these rules , a Government servant shall drawal pay in the revised pay structure applicable to the post to which he is appointed;
Provided that a government servant may elect to continue to draw pay in the existing scale until the date on which he earn his next or any subsequent increment in the existing scale or until he vacates his post or ceases to draw pay in the scale.
Provided further that in case where a Government servant has been placed in a higher pay scale between 1.1.2006 and the date of notification of these Rules on account of promotion, upgradation of pay scale etc., the Government servant may elect to switch over to the revised pay structure from the date of such promotion, upgradation, etc.
6. Exercise of Option: – (on page no 33-34)
(1) The option under the provision to rule 5 shall be exercised in writing in the form appended to the second schedule so as to reach the authority mention in sub rule (2) within three month of the date of publication of these rule or where an existing scale is revised by any order made subsequent to that date, within three month of the date of such order.
(2) The Option shall be intimated by the government servant to the Head of Office.
(3) If the intimation regarding option is not received with in time mentioned in sub rule (1), the Government servant shall be deemed to have elected to be governed by the revised pay structure with effect on and form the 1st day of January, 2006.
(4) The Option once exercised shall be final.
7. Fixation of initial pay in the revised pay structure: – (on page no 34-35)
(1) The initial pay of government servant who elects ,is deemed to have elected under sub rule 3 of rule 6 to be governed by the revised pay structure on and from 1st day of January ,2006, shall, unless in any case the President by special order otherwise direct, be fixed separately in respect of his substantive pay in the permanent post on which the hold a lien or would have held a lien if it had not been suspended, and in respect of his pay in the officiating post held by him, in the following manner , namely :-
(A) In the case of all employees:-
(i) The pay in pay band / pay scale will be determined by multiplying the existing basic pay as on 1.1.2006 by a factor of 1.86 and rounding off the resultant figure to the next multiple of 10.
(ii) If the minimum of the revised pay band / pay scale is more than the amount arrived at as per (i) above, the pay shall be fixed at the minimum of the revised pay band /pay scale;
Provided further that:-
Where , in the fixation of pay , the pay of Government servants drawing pay at two or more consecutive stages in an existing scale at bunched , that is to say , get fixed In the revised pay structure at the same stage in the pay band ,then, for every two stages so bunched , benefit of one increment shall be given so as to avoid bunching of more than two stages in the revised running pay bands. For this purpose, the increment will be calculated on the pay in pay band. Grade pay would not be taken in to account for the purpose of granting increments to alleviate bunching.
(iii) The pay in the pay band will be determined in the above manner. In addition to pay in the pay band , grade pay corresponding to the existing scale will be payable.
Note 7 :— (on page no 37-38)
Where in the fixation of pay under sub- rule (1), the pay of a government servant, who, in the existing scale was drawing immediately before the 1st day of January, 2006 more pay than another Government servant junior to him in the same cadre, gets fixed in the revised pay band at a stage lower than that of such junior, his pay shall be stepped up to the same stage in the revised pay band as that of the junior
Note 10 :— (on page no 38-39)
In cases where senior Government servant promoted to a higher post before the 1st day of January ,2006 draw less pay in the revised pay structure than his junior who is promoted to the higher post on or after the 1st day of January,2006,the pay in the pay band of senior Government servant should be stepped up to an amount equal to the pay in the pay band as fixed as for his junior in the higher post .The stepping up should be done with effect from the date of promotion of the junior Government servant subject to the fulfillment of the following condition, namely:-
(a) Both the junior and senior Government servant should belong to the same cadre and the post in which they have been promoted should be identical in the same cadre.
(b) The pre-revised scale of pay and the revised grade pay of lower and higher posts in which they are entitled to draw pay should be identical.
(c) The senior Government servants at the time of promotion should be have been drawing equal or more pay than the junior.
(d) The anomaly should be directly as a result of the application of the provisions of Fundamental Rule 22 or any other rule or order regulating pay fixation on such promotion in the revised pay structure. If even in the lower post, junior officer was drawing more pay in the pre-revised scale than the senior by virtue of any advanced increments granted to him, provision of this Note need not be invoked to step up the pay of the senior officer.
Rule 7 (2) :- (on page no 39)
Subject to the provisions of rule 5, if the pay as fixed in the officiating post under sub rule (1) is lower than the pay fixed in the substantive post, the former shall be fixed at the same stage as the substantive pay.
NOTE 2A, below rule 7 of the CCS (RP) Rules 2008 stated as under: – (on page no 37)
“Note 2A- Where a post has been upgraded as a result of the recommendation of the sixth CPC as indicated in part B or Part C of the First Schedule to these Rules, the fixation of pay in the applicable pay band will be done in the manner prescribed in accordance with Clause (i) and (ii) of rule 7 by multiplying the existing basic pay as on 1.1.2006 by a factor of 1.86 and rounding the resultant Figure to the next multiple of ten. The grade pay corresponding to the upgraded scale as indicated in column 6 of part B or C will be payable in addition. Illustration 4A in this regard is in the Explanatory Memorandum Rule

IMPLIMENTATION OF SIX CENTRAL PAY COMMISSION RECOMMENDATION FIXATION OF PAY AND PAYMENT OF ARREAR—- INSTRUCTION REGARDING.
OFFICE MEMORANDUM – F.No.1/1/2008-IC, Government of India /Bharat Sarkar, Ministry of Finance/Vitta Mantralaya ,Department of Expenditure/ Vyaya Vibhag (Implementation cell) New Delhi, the 30 August, 2008 clearly stated that-
The undersigned (MADHULIKA P.SUKUL. Joint Secretary to the Government of India) is directed to refer to the Central Civil Services (Revised Pay) Rules, 2008, notified vide G.S.R.No.622 (E) dated 29th August, 2008 and to state that in terms of Rule 6 of these Rules, Government servants are required to exercise their option for drawal of their pay in the revised pay structure in the format prescribed in the Second Schedule to the Rules.
2. The sequence of action to be taken on respect of the option will be as follows –
(i) The manner of initial fixation of pay in the revised pay structure has been indicated in rule 7 of CCS (RP) Rules, 2008. On the basis of this Rule, detailed Fixation Table for each of the pre-revised scales have been worked out in the manner recommended by the Six Pay Commission and are enclosed as Annex-I of this O.M. These may be used for the purpose of fixation in the revised pay structure as on 1.1.2006.
(ii) The table in Annex-I will be applicable in cases where normal replacement pay scales have been approved by the Government. In case of upgradation of posts and merger of pre-revised pay scales, fixation of pay will be as prescribed in Note 2A and 2B below Rule7(1) and in the manner indicated in illustration 4A & 4B respectively of the Explanatory Memorandum to the CCS(RP) Rules, 2008.

(2). The Entry Pay in pay band in the revised pay structure for direct recruits appointed on or after 1.1.2006 in Section II of PART- A of THE FIRST SCHEDULE, will not be applicable in cases, where post have been upgraded as on 1.1.2006.
(3). So, detailed Fixation Table for each of the corresponding to pre-revised scales (Revised PAY BAND / PAY SCALE) have been worked out in the manner recommended by the Six Pay Commission by fixation officer i.e. H.O.O./D.D.O. etc and will be used for the purpose of fixation in the revised pay structure as on 1.1.2006.
(4). Detailed initial fixation of pay in pay band and attached grade pay, will be used in case where posts have been upgraded e.g. post in pre-revised pay scale of Rs 3050-75-3950-80-4590 to Rs 3200-85-4900 scale have been worked out in the manner ,Note 2A below Clause (i) and (ii) of Rule 7(1),as per Illustration 4A.

This CCS (RP) Rules 2008, are applying on all the teachers (PRT, TGT, PGT, VICE-PRINCIPAL, PRINCIPAL, INCLUDING SPECIAL TEACHERS).
(3). INITIAL FIXATION IN PAY BAND, MANNAR PRESCRIBED IN CCS(RP) Rules, 2008 & CLAUSE (I)&(II) of RULE 7(1) Adopted by DIRECORATE OF EDUCATION , GNCT DELHI.
Fixation of pay as per CCS(Revised Pay )2008, and withdrawal of earlier order dated 12.09.2008 issued by GOVERNMENT OF NATIONAL CAPITAL TERRITORY, DIRECTORATE OF EDUCATION, COORDINATION BRANCH , OLD SECRETARIATE, DELHI-110084 vide O.O. No.PS/DE/2008/9527 Dated 18.09.2008 and clearly stated that-
“The matter regarding pay fixation of the teaching staff has been discussed with the guidance cell, principal account office, Govt of NCT of Delhi.
The pay of existing staff is to be fixed in the manner prescribed in accordance with the clause (i)and (ii) of Rule 7 by multiplying the existing pay as on 01.01.2006 by 1.86 and rounding the resulting figure to the next multiple of 10.
The grade pay corresponding to the upgraded scale will be payable in addition.
Illustration 4(a) in this regard is in the explanatory memorandum to these rules.
The clarification issued by the Implementation cell , Govt of India, Ministry of Finance, Department of Expenditure vide no.1/1/2008-IC dated 13.09.2008 is also enclosed for guidance.
Clarification 6: Office memorandum. F.No.1/1/2008-1C Government of India, Ministry of Finance, Department of Expenditure.(Implementation Cell) New Delhi dated 13th September ,2008 clearly stated that,
Procedure for placing employees in upgraded scales in case of merger of scale /upgradations recommended by the Sixth CPC.
(i} Where all post in one or more pre-revised scales are merged with a higher pre-revised scale and given a common replacement scale/grade pay , the suitability of incumbents need not to be assessed for granting them the higher replacement scale /grade pay and the incumbents will automatically be granted the replacement scale/grade pay recommended by the commission. Their pay will be fixed in the accordance with the fitment table annexed to this department’s O.M. of even number dated 30.08.2008.
(ii) Similarly; in the case of upgradation recommended by the pay commission; i.e. where all posts in a particular grade have been granted a higher replacement pay scale / grade pay , the suitability of the incumbents need not be assessed for granting them the higher replacement scale / grade pay. The incumbents will automatically be granted the replacement scale / grade pay recommended by the commission. Their pay band will be fixed with reference to their fitment table corresponding to pre-revised pay scale. However the grade pays corresponding to the upgraded post will be granted.
AND
The OFFICE MEMORUNDUM issued by F. No. 1/1/2008-IC Government of India , Ministry of Finance, Department of Expenditure, New Delhi the 13TH October 2008 :-
Subject: – Fixation of pay in the pay bands where posts have been upgraded as a result of recommendations of Sixth CPC clarification regarding.
Note 2A below rule 7 of the CCS (RP) Rules 2008 stated as under:-
“Note 2A- Where a post has been upgraded as a result of the recommendation of the sixth CPC as indicated in part B or Part C Of the First Schedule to these Rules, the fixation of pay in the applicable pay band will be done in the manner prescribed in accordance with Clause (i) and (ii) of rule 7 by multiplying the existing basic pay as on 1.1.2006 by a factor of 1.86 and rounding the resultant figure to the next multiple of ten. The grade pay corresponding to the upgraded scale as indicated in column 6 of part B or C will be payable in addition. Illustration 4A in this regard is in the Explanatory Memorandum Rules.”
The above procedure is to be adopted in all cases where pay scale have been upgraded by the Pay Commission , including Constabulary and other rank in the CPMFs/CPOs, Postmen and similar cadres in Department of post, Assistant and Section Officer in the central secretariat and other headquarter organization and common category cadres of Teachers and Nurses. This list is illustrative and not exhaustive.
All administrative Ministries/Departments are directed to ensure that in no case is there any deviation from the above [subject to other provision of CCS(RP) Rules , 2008 ].Pay fixed in the case of upgradation in any manner other than the above , will be rectified.
(4). CORRIGENDUM: – (Modification)
Ministry of Finance , Department of Expenditure, New Delhi modification notification on 12 march,2009 G.S.R. 161 (E) — in exercise of powers conferred by the proviso to article 309 of the constitution , the following Corrigendum Central Civil Service (Revised pay) Rules, 2008 is hereby issued:-
(i) Serial no 2 , which related to Trained Graduate teacher, in part XVII TEACHER, of the table under section II, Part B of the first schedule to the CCS(Revised Pay)Rules, 2008 shall be modified as under :-

The above detailed initial pay fixation in pre-revised pay scale of Rs 5500-9000 upgrade to existing revised pay scale Rs 7450-11500 as on 1.1.2006 , in PB-2 (9300-34800) & Grade Pay 4600 have been worked out in the manner prescribed in ,Note 2A below Clause (i) and (ii) of Rule 7(1),as per illustration 4A.
The above detailed initial pay fixation table clearly indicates that those teachers , having existing basic pay in pre-revised scale 5500-9000 between 7600 to 8475 i.e.( 7600,7775,7950,8125,8300 & 8475) as on 1.1.2006 only, will draw less pay in pay band PB-2 (9300-34800) to his junior teacher, the pay of such teachers will stepped up with reference to the revised pay of junior, if applicable [Note 7 & 10 below Rule 7(1) of CCS(RP)Rules,2008].
