    A representation may be made to 7th pay commission that the cut of date for implementation of pension w.e.f. 1.1.1986 may be shifted to 3i.12;2003 , as new pension scheme was implemented w.e.f. 1.1. 2004.THERE IS NO PROVISION OF PENSION FOR EMPLOYEES jioning between 1.1. 1986 till 31.12.2003. which is against the supreme court judgement that pension is a fundamental right.THERE IS EVERY POSSIBILITY THAT 7TH PAY COMMISSION MAY recommend in its favour. At least thousands of employees who joined between these dates mat get the benefit of pension . if it happens it may open more gates.do you agree with my proposal ?

      the cut of date 1.1.1986 is an executive and arbitrary where as the date 1.1.2004 is passed by the parliament

    Sir, I have joined KVS on 12.8.1981,& retired on 31.1.2014 , I am a CPF optee ,if our authority can consider my case for conversion from CPF to GPF from 1 .1.1986 will provide a little relief in leading life, the cost of living has increased tremendously which is creating hardship .
    I request yourself to look in to the matter & consider my case for conversion ,sir after serving for 33 years if our plea is not considered ,then it is an injustice, so please deal with sympathy & convert my case from CPF to GPF.

    I believe certain teachers form Chennai region have knocked at the doors of the High Court regarding conversion from CPF to GPF. Can we pursue on the same lines. Funds for the litigation can be collected from effected teachers. Cases like of teachers like Y Jyot can also be clubbed.

    This is an unfortunate and tragic story of a CPF optee of KVS who was granted SELECTION GRADE from 10/4/09 to 30/9/11 and given arrears in the month of July 15.The arrears drawn by the CPF optee was Rs.83439/- and the arrears drawn by a GPF cum pension optee ( who is also in the same cadre and for the same period) was Rs.81692/- just less of Rs.737/-. That means a cpf optee get cpf management share of Rs.737/-which is in lieu of pension plus dr etc etc. A gpf optee gets a differences in his pensions basic pay itself an increase of Rs.300/- per month . That means he gets BP plus DR on the first month of his prnsion itself an increase of Rs 700/- and through out of his life he gets the increased pension.

    IS THIS JUSTIFIABLE ?

    IS THERE NO ONE IN INDIA WHO CAN SEE THIS GROSS DISCRIMINATION ???

    I made several representations But every one prefers NOT TO UNDERSTAND .

      Do we have any ray of hope regarding conversion of CPF to GPF or please provide us latest update, in today’s economy its very much difficult to survive without pension amount and served for 33 years to Kendriya Vidyalaya but we are going back to our home with empty hands which is unfortunate for us.
      You are our inspiring leader and we have lots of hope from you to get us Justice.

    I very strongly feel and suggest that we move to High Court without loosing any time and before waiting for the out come of 7th pay commission. Our Union should take up this for the welfare of Kendriya Vidyalaya teachers/employees. Funds/litigation expenditure can be collected from effected teachers including the ones who have since retired.

    I did not even gave my consent for CPF or GPF as the documents never reached me. My husband was posted in field area during 1986 & I was with him when the options were asked for.

    Cases of teachers like Y Jyot, Hemendra and many more who have since retired should be clubbed on humanitarian grounds.

    WE CAN NOT AFFORD TO LOOSE ANYMORE TIME OR IT MAY BE TOO LATE!

    I have heard that Madam Usha Rani Singh From Delhi a won the case in CAT Principal Bench, New Delhi and KVS has published orders for converting her CPF account to GPF account.

      There was tea time discussions that many employees in ISRO have been granted conversion from CPF to GPF even after 20 years of service.When 6th pay commission is projected in medias in the year 2007 -08 , few employees have calculated that GPF with pension will be several times beneficial than Bank interest obtained with their CPF accumulations (bank interests started depleting year by year).

      Interested people please share your e-mail/ phone number, I can give the information about this.File an RTI application and get the details ,this may help you in administrative tribunal/court.

        In department of space(ISRO,satellite centre Bangalore) , conversion from CPF to GPF is allowed even after 01-01-2004( in the year 2006).

        Employees who have not exercised the option for conversion from CPF to GPF within prescribed 20 years from the date of joining, are allowed to migrate to GPF.

        Few employees to name are Dr.Shiela Iyer , Dr.Anand Kumar Sharma , S.Umakumari etc are benefited from this process.

    Yes.Dr.Anand Kumar sharma,deputy director ,Mechanical systems area,ISRO satellite centre,was granted conversion to GPF after 25 year.some one can extract these details through RTI from ISRO satellite centre and this will surely support your case in court.

    yes Dr.Anand Kumar sharma has been granted conversion from CPF to GPF after 26 years of service using high level influence in ISRO chairman level.I guess Dr.Madhavan Nair was the chairman at that time.
    Some one can collect the details under RTI and this will support your court case.

    I could get some reliable sources in ISRO/Dept of space. The option of CPF was available ONLY FOR TECHNICAL STAFF till 20 years. If no option is exercised till 20 years they’re deemed to be in GPF. Due to this many scientists were converted to GPF.This is as per rules, no matter of years of service. In ISRO also about 500 administrative staff is in CPF and no option to GPF is available to them. They have gone to tribunal but no relief is given. This is because as per rules no option to them is available.

    Very useful information. It is better to collect facts from reliable sources. When ISRO administrative staff could not get this relief from ISRO or tribunal as they are not covered under same CPF/GPF rules and no such option is therefore available.

    In ISRO CPF /GPF option was available only to technical staff up to 20 years. If no option is exercised in 20 years, then one is deemed to be in GPF. Hence people who haven’t opted in 20 years if they point out as per rule are in GPF.
    There are about 500 administrative staff in ISRO itself in CPF and they are not converted to GPF as there is no option available to administrative staff. I understand ISRO administrative staff has gone to tribunal citing scientific staff option, but no relief is given as this rule is not available for administrative staff in ISRO.

    I understand in IITs also.Faculty member have similar problem. No option is available but in IISc Bangalore some option was given. One has to clearly look into the rules and the language of option that was signed. Examples of other department/organisation may or may not be applicable universely.

    Whether it is Technical staff or administrative staff all are Government employees only.Rules are common to all.

    Many people in ISRO have misused the provisions.It is loot of public funds.

    Very interesting Ravi says “jWhether it is Technical staff or administrative staff all are Government employees only.Rules are common to all”.It shhould be but not CPF option itself was c kireated to technical staff for ease of leaving their job. 20 years switch over available for technical staff only and not for admin staff. Courts will look into rules it is therefore important to look into carefully and not just think emotionally. Ravi has some via, ISRO is not looting but doing a great job.

    Dr.Anand Kumar sharma,Deputy Director of Mechanical Systems Area, Staff No: IS0 2137 , ISRO satellite center,HAL airport road,Vimanapura post,Bangalore-560017,joined Government services in 1984 and moved to ISRO in the mid of 1985. During 1990 he voluntarily exercised an option to switched to CPF.

    He was allowed to switch over to GPF in the year 2007 December ,after 23 plus years of qualifying service as a special case.

    Above OM have given option to exercise conversion from CPF to GPF (vice versa)within 20 years of qualifying services.How ever Dr. Anand Kumar sharma who was under CPF at the time of issue of these orders has not exercised any option (who was voluntarily opted for CPF in 1990), When CPF to GPF switch over options are allowed in 1992 and 1996.

    After 1996 no such circular /amendments have been made by Department of pensions (as per the above mentioned website).

    Department of pension http://persmin.nic.in/Pension_Rules.asp , clearly mentions that

    “Earlier, the Government was giving option to CPF subscribers to switch over from CPF Scheme to GPF Scheme (Pension Scheme). The last such option was allowed based on the recommendations of Fourth CPC. As a number of options have already been allowed as and when substantial improvement were made in the pension scheme and the practical difficulties involved in retrieval of records and adjustments to be made, demand for further option was not recommended by the Fifth CPC and there is no proposal with the Government to consider any further change in options.”

    In the year 2007 keeping in view 6 th CPC , Dr.Anand Kumar Sharma was allowed to switch to GPF even after 23 years of qualifying services.Generally Department of expenditure, Ministry of Finance should approve these special cases.It looks there is no clarity about approval from Department of expenditure/Finance Ministry.Whoever speaks about this in his office are tortured and compelled to resign with the help of his strong influence in Departmental Head Quarters.

    It is universal truth that ISRO is doing great achievements- no doubt about it , one can not ignore the contribution of KV school teachers to the country.KV school teachers are also contributing equally towards nation building by educating our kids.
    Quality of education in KV schools is several times higher when compared with private convents which charges huge amount which middle cadre Government employee can not afford to pay.

    As per the above OM, technical staff in ISRO will join initially with CPF. Within 20 years of qualifying service they should exercise only option to switch from CPF to GPF-cum pension scheme and option once exercised is final.Those who do not exercise any option during 20 years of qualifying service are deemed to be switched over to GPF-cum-pension scheme (O.M. No. 4/1/87-P&PW(PIC-II) Dated 23/07/1996).

    When these orders are issued Dr.Anad Kumar sharma was in CPF (he has voluntarily opted for CPF in 1990 after joining ISRO in 1985 mid from CSIR-NAL), Above orders have given a fresh option to technical staff who are already in service as on 1st August 1992, who have not completed 20 years of qualifying service to switch over from CPF to GPF (vice versa) in 1992 and 1996.These orders strictly re iterates that such option should be exercised within 20 years of qualifying service.

    Suspense here is that, how Dr.Anand Kumar sharma based on the above office orders was allowed to switch from CPF to GPF-cum pension scheme after completion of 23 plus years of service??

    Uma please be specific and provide complete authentic information.

    Dr.Anand Kumar sharma,Outstanding Scientist ,Staff no. IS0 2137 , ISRO satellite center,HAL airport road,Vimanapura post,Bangalore-560017 has granted conversion from CPF to GPF after 23 years of qualifying service.
    Anand Kumar sharma joined NAL-CSIR in the mid of 1984 and joined ISRO in the mid of 1985.
    He opted for CPF in the year 1990.
    In 1992 and 1996 Department of pensions pensioners welfare has framed uniform policies for Department of Space,Atomic energy and Electronics, (OM 4/1/87-P&PW(PIC-II) dated 23/07/1996 and 4/1/97-P&PW(PIC-II) 12/10/1992). The OM says those technical staff who are already in service as on 1st August 1992 will be given one more fresh option to switch over from CPF to GPF and vice versa, how ever within 20 years of qualifying services.

    Dr.Anand Kumar sharma has not exercised any such option in 1992 and 1996.

    However in 2007 December keeping in view 6th CPC benefits Dr.Anand Kumar sharma was converted to GPF-cum-pension scheme after 23 plus years of qualifying service using his high level contacts in ISRO Head Quarter.

    This case can support KV school teachers case.

    He got blessings of many top level officials like ,Dr K N Shankara and Dr.G.Madhavan nair , both have become popular in 2G scam.
    For people who created billion dollar loss to Indian Government thorough 2G scam by violating several norms, violating CPF /GPF conversion law is not a big thing.
