    I feel now that if kvs administration / Ministry of HRD officials have some shame / humality left in them. They should immediately issue the order of implementation of MACP for kendriya vidyalaya teachers else will be slammed with multiple court orders for its implementation as the process has began.

    The new scales of kvs teachers will be as follows after the adoption of MACP and finance ministry approved ENTRY GRADE PAY.

    POST ,ENTRY GRADE PAY, AFTER 10 YRS , AFTER 20 YRS , AFTER 30 YRS
    PRT , 4600 , 4800 , 5400 , 6600

    As regards the scales i wish to inform that as per sixth pay commission recommended pay scale for PRT teachers is 6500-200-13500 AND EQUIVALENT GRADE PAY AS later RECOMMENDED BY FINANCE MINISTRY AND IMPLEMENTED BY KVS/MHRD IN CASE OF MACP SCALES FOR NON TEACHING STAFF IS Rs 4600.

    It is CERTAINLY HARD TO BELIEVE WHAT YOU HAVE WRITTEN ON TWO COUNTS :-

    1. Earlier MINISTRY OF FINANCE had given its NOC on the extension of macp to kvs teachers and left it to Ministry OF HRD to take the final decision.Thereafter only MHRD approved the file of extending macp for kvs teachers and formed a committee for its implementation. ( I hope Mr. Mazumder WILL AGREE WITH ME).

    2. Also if this is the explanation for rejection then how has it been approved and order issued for implementation of MACP for teachers of Union territories( ANDAMAN AND NICOBAR, PONDICHERRY, DELHI ETC.) few months back WHICH WERE NOT COVERED UNDER ACP EARLIER.( THEY EXTENDED ACP AND THEN MACP TOGETHER. This was just to comply to paper formalities. Similarly it can be done for TEACHERS OF KVS.

    Finally let us see what emerges out.

    It is sure that our stand is just and right.

    Also MACP has been granted to teachers of union territories who were not covered under ACP earlier then how can they refuse us.

    There is a time lag of one month.
    kvs will definitely take a decision without allowing for contempt petition.
    Union of india cannot go for appeal because kvs has already committed in letter dated on 2/7/13

    WAITE AND SEE THE POSITIVE OUTCOME.

    Sir,
    It is a wonderful step by the KV Teachers of RKVAS by merging into AIKVTA .
    The CPF holders of KVS are in very pathetic condition after their retirement. They get only just Rs 4 lakh ( served KVS for more than 27 years as TGT) in lieu of Pension and other benefits like Medical benefits Plus DA etc.. to a KVS GPF holders gets. Where as a similar employee of the same category, who is a GPF holder , gets more than 7 lakhs as their computation value . They get 60% balance pension + DA + Medical Allowance after retirement every month.
    Those who are serving now may not feel the condition now.

    Pl do the need full for the CPF holders to get pension or get the equal amount of pensionary benefits as GPF cum Pension holder gets .

    The CPF holders went to different Courts but unable to approach up to Supreme Court . Now also they have filed an OA in a CAT Chandigarh.

    Most of the CPF holders are finding some job after their superannuation even as a security wards for surviving. They are even requesting Govt. authorities to issue an order for mercy killing as all their requests were not looked in to …. .

    2) As per 6th CPC,s Report, as accepted by the Government, the pre-revised
    scales of Rs.5000-8000, Rs.5500-9000 and Rs.6500-10500 have been granted
    the identical revised Pay Band of PB-2 (Rs.9300-34800) with Grade Pay of
    Rs.4600. This is in accordance with recommendations of the 6th Pay
    Commission.

    As per the RTI Qn referred above, the pay scale of TGTs is in PB-2(9300-34800) with grade pay of Rs.4600.
    Shri.MJ is requested to post any Finance Ministry’s letter/order showing the grade pay Rs.4800 for the above pre-revised pay scales for the information of our readers & further action.

      Yes, Ministry of Finance (Deptt. of Expenditure) has rejected MACP to KV teacher recently and plea taken is- Govt. did not grant ACP to KV teachers; in spite of earlier letters & positive assurances… However the issue remains how GOI granted MACP to other UT schools who also were not granted ACP. This is illegal and all KV Teachers unitedly should fight it by all means, Rally by one and all on 5th Sept.- at Jantar Mantar ,New Delhi , all other state capitals& in all important cities/places KV teachers should come out in strength on road with out being cowed down by threats of dept. action etc. Cry to get milk… or remain hungry.

        Sir, since I ‘ve noticed that you seem to be quite well-versed with rules and regulations can you please clarify the following to me:
        I was appointed as PGT in the year 1988. I got my first financial upgradation in 2000. I was “promoted” in 2004 as Vice Principal but in the same pay scale that is 7500 – 12000. Am I entitled for a financial upgradation in 2012?

    AGITATION ON 5th SEPTEMBER,
    It is a good proposal to agitate on 5th Sept.as the authorities are be fooling KV teachers,rather exploiting and harassing by imposing undemocratic and illegal reforms in the name of quality education forgetting the role and commitment of teachers in the society.It is the attitude of the authorities to show that the reputation gained by KVS is the efficiency of their excellence and they are shedding crocodile tears on 5th Sept, in the name of a great teacher.KVS is celebrating its golden jubilee by kicking its employees in the street.
    friends,You have to do a lot of homework for making the agitation a success.Please remember that there will be a great opposition from our members as they feel that teachers should not go for strike.Please anticipate the threat and punishment to be imposed on you .
    The Association should serve notice well in advance and to communicate to every vidyalaya/ explain to every member why teachers are on war path.You may loose salary for the day of the agitation,get letters of threatening of disciplinary action under rule 14/16 of CCS(CCA) rules,not to recommend for “awards”or refuse to give awards and appreciation/ promotion/Sr.scale/Selection scale etc.
    The Office bearers are requested to approach the print and visual media for the publicity & support and to seek guidance from the Central govt/state govt employees’ Association.Usually the agitation fails due to proper communication among the employees.Please organize properly before doing the agitation.You can seek the guidance of the retired , senior& experienced colleagues .

    This letter only mean that if KVS follow this Court order then we can get benefit of 12-24-30 for all teachers, before this only 20% of teachers were getting the senior scale, now 20% barriers removed and its for all.

    May I have Your attention please ! we are not allowed to avail JOINING TIME if relieved in vacation.The Limit of within six month one can avail its joining time is not considered by the officials of KV. It is not about credit of joining time,but about refusing of joining time for those who have joined in vacation.
    If it is as per any existing rule ,then there is no problem,but if not “SUCH MISINTERPRETATION OF THE JOINING TIME RULES 1979 SHOULD BE VIEWED BY THE OFFICE BEARERS OF AIKVTA. Pricipals have been instructe to not give J T in Principal conference for such cases.

    I appreciate your suggestion cry to get milk.We really want a leader like you.Regarding this MACP we all teachers should be united and fight for getting milk.Let us come on the road for a big rally on 5th Sept.On that day don’t co-operate in any Vidyalaya matter.We will sacrifice 2 days salary for making the fight success.To all my friends,I also request to make success the fight,we will be one.Forget that you are in which association.Keep it in your mind that you are a Teacher and for all teacher friends we will join our hands.

    cat court order is regarding to Time Bond Promotion but it is posted under the heading COURT ORDEQ on MACP. What is the reason behind this? Please,clearify our confusion.

    KVS HAS EXTENDED MACP TO THE NON-TEACHING REGULAR APPOINTED GROUP “A” OFFICERS OF KVS(EXCLUDING PRINCIPAL) EXCEPT OFFICERS OF THE ORGANISED GROUP”A” SERVICES AT PAR WITH C.G.CIVILIAN EMPLOYEES W.E.F.01-09-2008 VIDE F.11029-16/2009-KVSHQ(ADMN.1) DATED25-02-2011.ACCORDINGLY,JC,DC,AC,Sr.Admn.OFFICER,EO,Sr.Audit& Accounts Officer,Ex.Engr,AO, ARE ELIGIBLE FOR MACP(3 GRADES).
    BUT THESE OFFICERS WERE NOT COVERED UNDER ACP AS THE GROUP OFFICERS(TECH & NON-TECH) WERE NOT COVERED IN THE ACP SCHEME AS RECOMMENDED BY THE 5TH CPC.
    THEREFORE,THE FINANCE MINISTRY’S PLEA THAT MACP CAN NOT BE GIVEN WITH OUT ADOPTING ACP.ASSOCIATION LEADERS MAY TAKE UP THE ISSUE EARNESTLY.

      I would like to have your comments on Mr Kurup’s observation.
      It appears he is right then why has now Ministry of Expenditure rejected MACP for KS teachers on the pretext that not covered under ACP where as in the same organisation MACP has been granted to officers not covered under ACP.

      This is a serious point and should seek explanation through RTI or CAT from KVS / MHRD /Ministry of Expenditure /GOI.

      THIS IS A MATTER OF NATURAL JUSTICE FOR ALL WHICH IS FORMOST FOR THE GOVT. OF INDIA TO ADHERE TO AS ITS VIOLATION IS A DIRECT ATTACK ON THE FUNDAMENTAL RIGHTS OF THE INDIVIDUAL / GROUP/ ORGANISATION.

      Govt.India, MOF(Dept.of Expenditure) letter is full of contradictions. 1.. While in the first para it refers to DOPT circular about implementation of MACPS being subject to implementation of earlier ACPS, it conveniently ignores that, as you have mentioned, Gr.A non-teaching officers in KVS and else where who were not covered under ACPS, have been granted MACPS. 2.. Many other UT administered school teachers who were not covered under ACPS are now granted MACPS. 3.. KVS being an autonomous organisation but being bound by UT rules and regulations, KV teachers should at least be treated at par with other such UT and even NCT Delhi teachers, in matters of pay & allowances and other financial benefits, if not more. (BOG decided to give KV Teachers more financial benefits than recommended for other teachers). …4…. While ACPS has been modified to include much better financial up gradation under MACPS, earlier instrument of senior/selection scale continued in the same length, denying service/financial benefits given to employees by GOI over and above the recommendations of 6th CPC. How this glaring omission is explained by knowledgeable officers in GOI? Why and how a sizable section of employees (teachers) be left out of a benefit package by GOI in the form of MACPS in current form which is much better than the one recommended by 6th CPC and without any concurrent modifications for further financial upgradation in senior/selection scale given in lieu of ACPS?

      In para 2 of the letter, it hints at KVS teachers not opting for ACPS , so MACPS cannot be granted now. It a deliberate diversionary design to mislead and misrepresent facts. In 2003 ACPS and the then prevailing senior/selection scale were two options and they were almost at par. ACPS was disadvantageous to kv teachers who often didn’t accept promotion due to dislocation/ displacement liability. So the then working GS AIKVTA opted to continue with senior /selection scale with a rider that the limitations of 20% in selection scale should also be waived. This was a non-binding(on KVS) option from Mr. S.Malik who was the working GS of AIKVTA and whom KVS did not recognize as regular GS. Leaving aside the question if a working GS who was only authorized to look after day to working of AIKVTA sans policy matters could write such letter or not; leaving aside the fact that KVS which harp on this letter but never recognized the author of the letter as the GS of AIKVTA till 2010, why the first part of this option letter, to continue with senior scale/selection scale instead of ACPS was accepted ignoring the other part about waiving of 20% limit for selection scale? Is there any other instance when KVS/GOI accepted any option given by any one Association on financial matters? Are all teachers in KVS bound by letter written by representative of one Association opting for a particular financial package? Even accepting that, are the employees working in NVS / CTS/ DM school / Railway school were also represented by Mr.S Malik? Why were they not granted ACPS? 5…. GOI circular on implementation of ACP clearly states that the department/employer, not the employees to opt for ACP.Why and how then the KV employees option was taken.Was it not a design to deny ACP to KV Teachers?

      The option given by Mr.Malik was in 2003, but in 2004 & 2005 repeatedly GOI circulars (available in this web site) mentioned that ACPS is not meant for teaching cadre, irrespective of there services in KVS or NVS/CTS/ other such UT controlled school. Why Govt. hides its own irrational policy decision not to grant teachers ACPS?
      I, as the then GS AIKVTA, repeatedly wrote to KVS from Moscow to grant ACPS to KV teachers. I have all records with me. What made KVS to ignore my letters on ACPS while still recognizing me as the legally elected GS of AIKVTA?

      Now that the decision of Govt. is out, we can proceed with consequential actions. The Delhi CAT direction has to be interpreted in the light of existing norms for grant of MACPS. Waiving of 20% limit from selection scale is no alternative for MACPS. Third up gradation after 30 years of service but with a gap of only 6 years between selection scale(24 yrs) and the proposed third up gradation is a matter of further examination.So let’s prepare for further relief from appropriate legal forums in due course.

    MACP & KVS.
    MoF,D.Exp,E.III(A),Branch has disposed of the file seeking approval to grant of MACP to KV Teachers was disposed of on 04-07-2013 before the verdict of the case filed by RKVAS and others and the judgement was pronounced on 22nd July 2013 by the Principal bench CAT New Delhi and the Respondents have been given time to issue orders within one month.Hence, the above referred letter of the Finance Ministry becomes void.Therefore, The Finance Ministry has to comply with Hon’ble CAT’s order else the Ministry has to go for appeal in the Division Bench of the High Court Delhi.There is very remote chance since CAT has disposed of citing a supreme court order not to have any restriction of giving Selection scale(20%).
    After seeing the KVS order again we can challenge in the CAT and this can be filed in different Benches of CAT and teachers should come forward to file the case instead of asking the Associations alone to file the case, even some groups can also take initiative.
    ISRO school teachers also won the MACP case on 30th JULY 2013, which was filed in the Hon’ble CAT,Hyderabad.The version of the judgement has not been received till now. NVS Teachers’Association has also filed a case regarding MACP in the Principal Bench.The case is pending there.
    Another Case filed for MACP in the Hon’CAT, Ernakulam is pending,as the respondents did not file the counter statements,hence it is in the Registrar court.It will be posted to Judge’s Bench after they comply with statements.
    At any rate The KV Teachers should get MACP and all should work for it.

    teachers are deplpoyed by various region by conducting the workshop on national holidays and forcing to take the extra classes during winter break. Although the conference of principal and DC have been conducting in the working days.So aikvta should raise this issue

    dictum of the supreme is to be followed .it means that there will be no stagnation of any employee.so 20percent restriction is struck down.there was no provision of any higher pay after 30 years as there were only two upgradations of sr and selection scales.so giving upgradation after 30 years is like acceptance of macp.as there is no provision of sr and selection scales in 6th pay scale and dictum of supreme is to be followed that means automatically macp has to be implemented as per this order of cat. AM I RIGHT?

    Some Principals are blaming the Association(AIKVTA)that association is going against them.The Principal should think over the matter why the association taking interest.Harrassing Teachers by the Pricipal is not an offence ? Going against the Teachers,Telling so many things to others without knowing nothing is not a crime ? So why the authority will get respect and support from the staff ? An Administrator quality should be polite.pleasing and with a smile taking the works from the staff.We may not be an administrator or never be a principal but we can deal with a good manner.

    now for example a tgt initial gp is 4800 and as per cat’s judgement after 30 years, as per the latest pay commission ,his third upgradation will be from 4800 to 7600 affter total input of 30 year of service,because sr scalle is having gp of 5400 and selection grade gp will be 6600 .a senior scale is the next scale ie of pgt and selection scale will be next gp of 6600.all these are to be refixed with effect from 1.1.2006. the only difference is that first gp will be after 12 years insteadof 10 years and next after 24 years. ai i rigth?

    Sir, After serving 20 years as a PGT, I am not in a position to get my Senior Scale, which was due from 1.1.2006. How long will the KVS stop my Senior Scale? Isn’t this stern stopping of the said Senior scale against natural justice or not? Pl justify me and do the needful.

    Sir I am denied the Senior Scale w.e.f. 1.1.2006 for more than 8 years in KVS. I joined in KVS in Feb 2004 and completed 20 years as a PGT. But still the KVS did not consider my continued representations. Two Principals spoiled my ACR/APAR ( one in 2005-06 and another in 2010-12). How long the KVS will stop my Senior Scale which is purely against the natural justice? I want justification at an early date pl.

    mr x wants to know:-he was appointed &joined after training as tech_II,(in present pay band rs.5200 to 20200,gp rs.2400) in may 1982.He is promoted and posted as TCI-III(present JE/T) through intermediate apprentice quota in 1988 (Rs.1400/- to 2300/-,9300/- to 34800/- & gp rs.4200/-)Next promotion to TCI-II(JE/T/I,present JE/T)in pay rs 1600/- to 2600/-,9300/- to 34800/- with gp 4200/-.Went on deputation to ex-cadre post in scale rs.6500/- to 10500/- for the period betn April 2000 to March 2006.Reverted to his present cadre in April 2006.What will grade pay on macp in 1.9.2008?What will be in may 2012?How many macps will he get?Pl give a reply.

    I have joined 19/01/1984 as stenographer gr. III, got promotion as Steno gr. II March,1996. During sixth pay commission, grade pay rs. 4600/- has been fixed & 2nd ACP got 4800/- w.e.f. 19/01/2008 and how much grade pay will be fixed after completion of 30 year i.e. 19/01/2014.
